Terms & Conditions

Cancellation Policy

We have an 8 hour cancellation policy for all of our classes.

Classes must be cancelled at least 8 hours before your class starts (which can be done through the Studio Growth app / your Nimble Pilates Studio profile) in order to have your class credit reinstated.

Cancellations made after this window will mean that your class credit will be forfeited.

Class Waitlists

If a class is full, you will have the option to elect to be on the waitlist. If a place then becomes available in the class you will then be notified and moved off the waitlist, into the class.

The minimum notice period to be moved from a waitlist into a class is 2 hours prior to the class start time.

Please note when you elect to be on a waitlist, a class credit will be held to allow this. If you are then moved from the waitlist into the class, the class credit will be used. Alternatively if you remain on the waitlist, the class credit will be reinstated to you following the class time.

Nimble Pilates Studio - Risk Warning and Waiver

In order to attend Nimble Pilates Studio, all participants must agree to the following waiver: 

 

1.      Risk Acceptance

I understand that participating in Reformer Pilates classes involves physical exercise and the use of specialised equipment. I acknowledge that these activities carry inherent risks, including but not limited to:

  • Muscle strain, sprains and soft tissue injuries

  • Falls from reformer beds or equipment

  • Injury caused by incorrect use of springs, straps or moving parts

  • Aggravation of pre-existing injuries or medical conditions

  • Fatigue, dizziness or loss of balance

  • In rare cases, serious injury or death

I voluntarily participate in Reformer Pilates classes at my own risk.

 

2.      Medical Declaration

I confirm that:

  • I am in good physical health and able to participate in Reformer Pilates;

  • I have no injury, illness, medical condition and I am not pregnant (or I have obtained medical clearance from a doctor and informed Nimble Pilates Studio);

  • If my physical health changes after signing this Waiver, I will notify Nimble Pilates before participating in any further classes.

 

3.     Release and Waiver of Liability

To the fullest extent permitted by law:

  • I release and discharge Nimble Pilates Studio, its owners, instructors, employees and contractors from any and all liability (including liability arising from negligence), claims, demands, actions or causes of action arising from or in connection with my physical injury or mental injury or death, as a result of or in connection with my participation in classes, my failure to follow instructions or directions, my misuse of equipment or my failure to comply with clause 2 or clause 4 of this document; and

  • I agree that, to the extent permitted by section 139A of the Competition and Consumer Act 2010 (Cth), Nimble Pilates Studio excludes, restricts or modifies its liability for any failure to comply with consumer guarantees under the Australian Consumer Law in respect of my physical injury or mental injury or death, and I acknowledge and agree that the services provided by Nimble Pilates Studio are “recreational services”.

Nothing in this waiver excludes Nimble Pilates Studio’s liability for reckless conduct.

 

4.     Personal Property

I understand that Nimble Pilates is not responsible for any loss, theft, or damage to personal property while on Nimble Pilates’ premises.

 

5.      Participant Responsibilities

I agree to:

  • Follow all instructor directions and studio rules;

  • Use equipment only as directed and not adjust settings without guidance;

  • Immediately stop the activity and inform the instructor if I feel unwell, experience pain or discomfort, or am unsure of how to use the equipment.

I acknowledge that instructors provide general guidance only and do not provide medical advice, and that I am responsible for monitoring my own physical condition.

 

6.     Photography and Media Consent

Unless I notify Nimble Pilates Studio in writing, I grant Nimble Pilates Studio permission to use photographs and/or video recordings of me taken in classes or events for business purposes, including but not limited to quality assurance, education, social media, marketing, and promotional materials.

I waive any right to compensation or approval of the finished product.

 

7.     Minors (Under 18) and Parental/Guardian Consent

By checking the acceptance box, you certify that you are at least 18 years of age. If you are accepting this waiver on behalf of a participant under the age of 18 ("Minor"), you represent and warrant that you are the parent or legal guardian of that Minor. You explicitly agree that both you and the Minor will be bound by all terms, conditions, and liability releases outlined in this agreement. You accept full legal and financial responsibility for the Minor’s participation, safety, and actions within the studio.

 

8.      Severability

If any provision (or part of a provision) of this document is found to be void, invalid or unenforceable, that provision (or the relevant part of that provision) will be severed to the extent necessary, and this document will otherwise continue in full force and effect.

 

9.     Acknowledgment

I confirm that:

  • I have read and understood this document;

  • I agree to be bound by its terms.
